Terms and Conditions

Registration

1. Only registered bidders may bid at auction. In House bidders can register by completing a bidding card prior to the auction giving full name, address and contact details. Absentee bidders can register by contacting Hayward's Auction House. Internet bidders must register online prior to the auction according to the registration procedures outlined there.

Bidding
2. The highest bidder shall be the purchaser, subject to the auctioneer having the right to refuse the bid of any person and subject to any reserve having been met. Should any dispute arise as to the bidding, the lot in dispute will immediately be put up for sale again at the preceding bidding. Or the auctioneer may declare the purchaser which declaration shall be conclusive.

3. The auctioneer shall set the bidding increments and no bid may be retracted.

4. The auctioneer reserves the right to bid on behalf of the vendor up to the reserve figure.

Reserves
5. All lots are sold subject to the right of the seller or his agent to impose a reserve.

Buyer's Premium
6. A buyer's premium for in house bidders of 10% will be added to the total fall of the hammer price along with a local GST tax of 12.5% on that premium. For buyers bidding via eBay Live Auctions, the buyer's premium will be 15%.

Payment
7. Successful bidders are required to make full payment within 7 working days of notification of their purchases. Payment can be made by cash (in house only), cheque, direct bank credit or Eftpos (In House) or by direct bank credit or Visa or Mastercard (Overseas buyers) If payment is made by credit card " Visa or Mastercard " an extra 2.5% charge will be added to payment. The auctioneers reserve the right to request identification in the case of any purchaser not known to Hayward's who pays by cheque or bank draft.

Lots Offered and Sold as Described and Viewed
8. All lots are sold as shown and with all errors to description, faults and imperfections whether visible or not. Neither Hayward's nor its vendor is responsible for errors of description or for the genuineness or authenticity of any lot or for any fault or defect in it and make no warranty whatever. Buyers proceed upon their own judgment. The act of bidding is agreed by the buyer to be an indication that they are satisfied as to the condition of the goods. All efforts are made by Hayward's to describe goods accurately and staff will provide further information and images if requested to do so. However, all goods are sold "as is' and "without recourse' and Hayward's are not responsible for any colour discrepancies due to photo reproductions.
All statements in the catalogues, descriptions or advertisements are statements of opinion, and are not to be relied on as statements of fact, and intending purchasers must satisfy themselves by inspection or otherwise as to the genuineness, condition, provenance, etc of any goods offered for sale. Neither the vendor nor Hayward's is responsible for any representation or warranty.

Hayward's as Agent for the Vendor
9. Hayward's act as agents for the vendor. They have full discretion to conduct all aspects of the sale and to withdraw any lot from the sale without giving any reason.

Possession and Risk Relating to Goods
10. Risk passes to the purchaser at the fall of the hammer but goods cannot be removed from the Rooms until paid for and a receipt issued. Goods purchased are to be taken away at the purchaser's expense immediately after the sale or arrangements made with Hayward's regarding their storage and collection. If this is not done Hayward's will not be responsible if goods are lost, stolen, damaged or destroyed.

Failure to make Payment
11. If for any reason the purchaser fails to complete his purchase as aforesaid, the auctioneer reserves the right to resell the lot. Any net increase in price shall be the property of the vendor. The purchaser shall be called upon to make up any loss of deficiency of any such resale together with all the expenses attending such a sale.

Absentee Bids
12. Absentee bids are welcome, and the auctioneer shall accept bids by mail, telephone, fax, or by e-mail. Bidders will receive an invoice after the auction. Payment should be forwarded on receipt of the invoice. Delivery shall be made to bidders on receipt of
payment.

Shipping/Delivery
12. Packing, shipping and associated insurance costs are to be paid by the purchaser. Unless otherwise requested delivery will by made by courier or (in NZ) ordinary mail; overseas by airmail.

Acceptance of Terms and Conditions
13. The act of bidding is deemed to be acceptance of the Terms and Conditions outlined above.
